As referenced in this previous thread, the Legacy Trail project has recently run into some controversy that could determine the fate of the project before it even begins:

As some forum members have expressed, this whole issue is not a cut and dry, good idea vs. bad idea scenario. On one hand, the trail could get built and could provide a nice recreational facility for Lexington. On the other hand, there is some speculation over the implications of the land swap between UK and Vulcan Materials, and whether or not those implications could have an environmental impact in the future, as the swap would give Vulcan mining rights to their holdings in the land swap.

Since this involves issues that are important to many of us on the forum, I encourage you to find out more about this issue and where you stand on it. As recent developments in our city have shown us, it is our civic responsibility to speak out when faced with decisions that impact our lives now and in the future.

The meeting with the Board of Adjustment is next Friday, December 12 @ 1pm in the Council Chambers (otherwise known as "the chamber where all the really bad decisions in Lexington get enacted"). According to the agenda for the meeting, the issue is first in line.

here is a response I received from Steve Austin about some of my concerns about the mining

all mining with this deal would be underground - the city of georgetown has issued a firm letter of support that they are not concerned about the Royal Spring - the lexington planners and environmentalists have recommended approval of this as well

I personally would never advocate anything that would endanger the aqifer

Vulcan already has the right to mine the surface of the land they will swap to UK - this deal is better not only for UK and the Legacy Trail, but for the overall environment

Thanks for talking to Steve, Tim. I was working on an email to him when I saw your post. I am going to the meeting in support of the landswap and the trail. I agree with much of what has been said about the pros and cons of onroad facilities versus off-road ones like the Legacy Trail. I think the MAIN benefit of this type of facility is that it provides a place where people of all skill levels and experience can feel comfortable riding a bike. This with hopefully lead to more people feeling comfortable riding their bikes everywhere. My two cents...

This clears the way for a land swap of surface for mineral rights between UK and Vulcan, and directly allows for the Legacy Trail to move ahead.

This application was supported by city planners, environmentalists, numerous businesses and organizations, and the city of Georgetown, which gets its water from the Royal Spring in this area. We will use the Trail to teach people about the importance of protecting ground water, using this area as a prime example of positive management.

Thanks to the dozens of people who wrote letters of support, and to the more than 35 people who attended the meeting in support of the project. It is moving that so many of you care so much about the Legacy Trail.

Next is for the public to review the preliminary design from the trail planners. This will happen on Tuesday January 13th at the NorthSide YMCA on Loudon Avenue. We’ll send out more information later. But we can tell you that this will be an exciting event – there are some great design concepts floating around!

So the meeting started at 1 and I had to leave at about 2:45. If there were more than 35 people there in support of the trail they must all been in suits because the small bike support I saw was about 5 people including myself.

I will spare you the details but every member on the committee said they were in support of the trail but needed more information about the mining. It was a very difficult issue for me to sit there and listen to promises made by the mining company. I am in support of the bike trail but find it hard to support a mining company in order to get a trail.

So yeah we can celebrate that we will now have a 9 mile trail to the horse park. Hopefully all of the exec, suits, legacy people will continue to work towards a bike friendly community and not die once they get their trail.
