The following bill is proposed in the state House of Reps. by Rep. Osborne from Jefferson/Oldham County. It has been assigned to the Transportation Committee.


HB 255 (BR 1113) - D. Osborne
AN ACT relating to bicycles.
Create a new section of KRS Chapter 189 to prohibit the operation of a
bicycle on a state-maintained highway while transporting a person under
the age of 18 years in an attached trailer or other apparatus.

Jan 13-introduced in House
Jan 19-to Transportation (H)

I spoke with Rep. Osborne this morning and he stated he is not a cyclists and is not against cyclists he just stated that he had a very close encounter on Highway 1694 where he came around a corner and a cyclists with a trailer was doing a u-turn in the road and he came within three inches of hitting the trailer.

Did you ask why he's not sponsoring a no U-turn bill, since that seems to be the actual problem?

Taking your kid on a 45+mph highway with a trailer does seem somewhat irresponsible. If it passes, seems it would just give more incentive to build bike trails so people have somewhere to take their kids/trailers.

If a highway is restricted to certain modes of transportation, that's all fine and good... but I don't think any further restrictions should be made for any roads that already allow for bikes.

I agree somewhat about it creating attention for the need for bike trails but it seems like it could also potentially create a cascade of other legislations against cycling. Wouldn't it be nice if one day you are riding your bike and someone in a car cuts you off and you could just propose a legislation against cars passing anyone on a bike? It seems like knit-picky bullshit. What if that is your only mode of transportation? What gives a person the right to regulate a group for which he has no addmited experience without their input or opinion? I can understand the need to protect children but i think this needs to be thought through.

I’m extremely sorry about your close encounter with a very foolish and rude bicyclist. Just as there are motorists who don’t obey the rules of the road, alas, there are also a very few cyclists who don’t.
I hope you will reconsider your decision to introduce this very counter-productive legislation. With our efforts to slim down Kentuckians, to make them more healthy, and to reduce our dependence on foreign energy, we don’t want to make one form of exercise and fuel-efficient transportation nearly impossible.
